Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cutola(the "Service"), an online automated background removal and image enhancement tool operated from the United Kingdom. By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old, or the age of digital consent in your country, to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Authentication is handled by our identity provider, Clerk; you are responsible for the accuracy of the information you supply.

2. Credits and the Service

The Service operates on a pay-as-you-go credit model. Certain tools consume credits per image processed, while others (such as resize, convert, and compress) are free to use. Credits are a prepaid licence to use processing capacity; they have no cash value, are non-transferable, and do not constitute a stored-value or e-money instrument. We may change the credit cost of individual tools with reasonable notice.

3. Acceptable use

You agree not to use the Service to upload, process, or distribute content that:

  • infringes the intellectual property, privacy, or other rights of any person;
  • is unlawful, defamatory, obscene, or constitutes child sexual abuse material;
  • depicts an identifiable person without that person's consent, or is used to impersonate, misrepresent, or create misleading depictions of any person;
  • you do not have the necessary rights or permissions to upload and process; or
  • attempts to reverse-engineer, overload, or circumvent the technical limits of the Service.

We may suspend or terminate accounts that breach these rules, and may remove content without prior notice where we reasonably believe it is unlawful.

4. Your content and rights

You retain all ownership of the images you upload and the outputs you generate. You grant us a limited, temporary licence to store and process your images solely for the purpose of providing the Service to you. Uploaded files and generated outputs are stored in Cloudflare R2 and are automatically deleted after a retention period. We do not use your images to train our models.

5. Payments

Payments for credits are processed by Polar Software Inc. (polar.sh), which acts as the Merchant of Record for all purchases. Polar handles billing, tax collection, and payment disputes. Your purchase is therefore also subject to Polar's buyer terms. Prices are shown at checkout and may include applicable taxes.

6. Refunds

Because credits are consumable digital goods, our ability to offer refunds is limited. Please see our Refund Policy for full details.

7. Availability and disclaimers

The Service is provided on an "as is" and "as available" basis. Automated image processing is not exact and we do not warrant that every output will meet your expectations. To the fullest extent permitted by law, we exclude all implied warranties. Nothing in these Terms limits your statutory rights as a consumer under UK law.

8. Limitation of liability

To the extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid us for credits in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential loss, loss of data, or loss of profits. We do not exclude liability for death or personal injury caused by negligence, or for fraud.

9. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access for breach of these Terms. Unused credits are forfeited on account closure, subject to your statutory rights and our Refund Policy.

10. Changes to these Terms

We may update these Terms from time to time. Where changes are material, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that nothing affects your rights to bring claims in your country of residence where required by mandatory consumer law.
